Agreement to terms

These Terms & Conditions constitute a legally binding agreement between you and American Diving (“we,” “us,” or “our”) concerning your access to and use of the divesouthpadre.com website (the “Site”).

By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you must discontinue use of the Site immediately.

We reserve the right to make changes to these Terms at any time. We will indicate changes by updating the “Last updated” date above. Your continued use of the Site after any revised Terms are posted constitutes your acceptance of the changes.

The Site is intended for use by residents of the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws where they apply.

Intellectual property rights

Unless otherwise indicated, the Site is our proprietary property. All source code, design, photographs, video, text, and graphics on the Site (the “Content”), and the trademarks and logos it contains (the “Marks”), are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

The Content and Marks are provided for your personal, non-commercial, informational use only. No part of the Site or its Content may be copied, reproduced, republished, distributed, or otherwise exploited for any commercial purpose without our express prior written permission.

Booking a snorkel trip

Guided snorkel trips shown on this Site are scheduled and paid for through our booking partner, FareHarbor, via the “Book Snorkeling” link. Your booking, payment, and any cancellation or rescheduling are subject to FareHarbor's own terms of service. We are not responsible for the operation of the FareHarbor platform itself.

Trip availability, pricing, and details shown on the Site are provided for general information and are subject to change; the booking details confirmed through FareHarbor at the time of purchase govern.

Prohibited activities

You agree not to use the Site to:

• Systematically scrape, harvest, or compile Site content using automated tools, bots, or scripts.
• Attempt to circumvent, disable, or interfere with any security-related feature of the Site.
• Interfere with, disrupt, or place an undue burden on the Site or the networks connected to it.
• Attempt to decompile, disassemble, or reverse engineer any software that is part of the Site.
• Impersonate American Diving or any of our staff, or otherwise mislead visitors about the source of any content.
• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Harass, threaten, or abuse our staff or other visitors in connection with your use of the Site.
• Upload or transmit viruses, malware, or any other code intended to disrupt the Site's operation.

Third-party websites and content

The Site links to third-party websites, including our booking partner FareHarbor, our social media profiles, and, on our Texas Clipper page, the Texas Parks and Wildlife Department. These third-party sites are not operated or controlled by us, and we are not responsible for their content, accuracy, or privacy practices. If you leave the Site to visit a third-party website, you do so at your own risk and that site's own terms and privacy policy will govern.

Site management

We reserve the right, but not the obligation, to:

• Monitor the Site for violations of these Terms.
• Take appropriate legal action against anyone who violates the law or these Terms, including reporting to law enforcement where warranted.
• Remove or disable access to any content on the Site, at our discretion and without notice.
• Otherwise manage the Site in a manner designed to protect our rights and property and keep the Site running properly.

Disclaimer

The Site and its content are provided on an “as is” and “as available” basis. We make reasonable efforts to keep information about our services, dive sites, and trips accurate and current, but we do not warrant that the Site will be error-free, uninterrupted, or that all information is complete or current at all times.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles, and any dispute arising from these Terms or your use of the Site will be subject to the jurisdiction of the courts located in Cameron County, Texas.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision of these Terms does not waive our right to do so later. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
